Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the ClearRay Solar website (portal.segen.co.uk), products, and services. By accessing or using our site, you agree to be bound by these Terms. If you disagree with any part, please stop using our services immediately.

Use License & Restrictions

Permitted Use

We grant you a non-exclusive, non-transferable license to:

Technical Advice

Any technical guidance provided by ClearRay Solar is given in good faith based on the information supplied. It remains the customer's responsibility to verify product suitability, system design and compliance with applicable regulations before installation.

Electrical Installation

Many products sold by ClearRay Solar must be installed by suitably qualified persons in accordance with applicable legislation, manufacturer instructions and current electrical regulations. Failure to do so may invalidate warranties and create safety risks.

System Design & Product Compatibility

ClearRay Solar supplies individual components and complete system packages. Unless expressly agreed in writing, the customer is responsible for ensuring all selected products are compatible with each other and suitable for the intended installation. Any recommendations or compatibility information provided by us are for guidance only and should be independently verified by a competent installer before installation.

Pricing & Payment

Price Terms

• All prices are in GBP. All prices displayed on the website indicate whether VAT is included or excluded
• Prices are valid only for online orders through our portal
• We reserve the right to change prices without notice
• The price charged is the price in effect when you place your order
• Obvious pricing errors do not constitute a binding offer

Payment Processing

• Payment must be received before order processing
• We accept credit cards, bank transfers, and other stated payment methods
• All payments are processed by secure, PCI-compliant providers
• You are responsible for maintaining payment information accuracy
• Fraudulent payments may result in account termination and legal action

Order Confirmation

An order confirmation email does NOT constitute acceptance of your order. We reserve the right to refuse orders, verify customer information, and cancel orders if:

• Payment fails or is declined
• Items are out of stock, discontinued, or subject to a supplier shortage
• Information provided appears fraudulent or incomplete, or fails fraud checks
• Delivery destination is outside our service area

Shipping & Delivery

Delivery terms are governed by our Shipping Policy, which forms part of these Terms.

• Service Area: We deliver to UK only
• Risk Transfer: Products remain our responsibility until delivered to your location
• Signature Required: High-value orders may require a signature upon delivery

Undeliverable Orders

If an order cannot be delivered after reasonable attempts, we may:

• Return the order to our warehouse at your expense
• Store the order (storage fees may apply)
• Refund the order minus shipping costs

Returns & Refunds Policy

Please see our dedicated Refund Policy for complete information on returns, exchanges, and refunds. Key points:

• Standard returns accepted within 14 days of delivery
• Products must be unused and in original packaging
• Return shipping costs borne by customer (unless item is defective)
• Refunds processed within 5-7 business days of return inspection

Manufacturer Warranties

Limited Warranty

All products come with manufacturer warranties as stated in product documentation. ClearRay Solar provides:

• Defect Coverage: Protection against manufacturing defects for the stated warranty period
• Exclusions: Warranty does NOT cover misuse, improper installation, normal wear, or damage from external factors
• Warranty Claims: Must be submitted with proof of purchase and detailed description of defect

Consumer Rights

Nothing in these Terms excludes or limits any statutory rights available to consumers under applicable UK law, including the Consumer Rights Act 2015.

Limitation of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or limited under English law.

Our total liability shall not exceed the amount you paid for the product or service in question.

Intellectual Property Rights

All content on our site—including text, graphics, logos, images, product designs, specifications, databases, software, CAD drawings, our configurator, our BOM builder, and page layouts—are owned by or licensed to ClearRay Solar and protected by UK and international copyright laws.

You may not:

• Reproduce or distribute our content without permission
• Use our trademarks or branding in your marketing
• Create derivative works based on our designs

User Accounts & Credentials

Account Responsibility

You are responsible for:

• Maintaining confidentiality of your login credentials
• All activity on your account
• Notifying us immediately of unauthorized access
• Keeping your profile information current and accurate

Account Suspension

We may suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Harass other users
• Have payment disputes or chargebacks

Limitation of Service

We may at our discretion:

• Limit quantities per customer to prevent hoarding or fraud
• Restrict access to certain products based on location, experience level, or other criteria
• Modify or discontinue products or services with notice
• Perform maintenance requiring temporary service interruption

Website Availability

We do not guarantee uninterrupted access to the website and may suspend access for maintenance, upgrades or security reasons.

Indemnification

Trade Customers

Where goods are purchased in the course of business, different statutory rights may apply compared with consumer purchases. Trade customers should ensure products are suitable before ordering.

Force Majeure

We shall not be liable for failure or delay in performing our obligations where such failure results from events beyond our reasonable control including severe weather, industrial disputes, transport disruption, acts of government, supplier shortages or telecommunications failures.

Export Controls

Customers are responsible for ensuring compliance with any export controls or import regulations applicable to products purchased from us.

Privacy

Personal information is handled in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to its conflict of law principles. Any disputes shall be handled through:
